Terms of Use

Mortgage Mind AU (the App) is published by BraindAI Pty Ltd (ABN 61 701 238 968) (we, us, our). These Terms of Use (Terms) apply when you download, access or use the App on any device. By using the App you agree to these Terms. If you do not agree, please do not use the App.

These Terms should be read together with our Privacy Policy at braindai.com/mortgagemind/privacy.

The App provides calculators and educational content about Australian home loans, property purchase costs and personal tax.

• Estimates only. All results, charts, reports and PDF exports are mathematical estimates for general information and illustration. They are not a quote, offer, pre-approval or approval for any loan.
• Not financial, credit or tax advice. Nothing in the App is personal financial product advice, credit assistance or a credit service under the National Consumer Credit Protection Act 2009 (Cth), financial product advice under the Corporations Act 2001 (Cth), or tax advice. The App does not take your objectives, financial situation or needs into account.
• Rates and rules change. Calculations use interest rates you enter and government rates, thresholds and concessions (for example stamp duty, first home buyer schemes, income tax and the Medicare levy) as published when the relevant App version was released. Governments and lenders change these regularly, and lenders apply their own assessment policies, so your actual costs, repayments and borrowing capacity may differ.
• Check before you act. Before making any financial decision, confirm figures with your lender, a licensed mortgage broker or credit representative, a financial adviser, a registered tax agent, or the relevant state or territory revenue office.

You must be at least 18 years old, or use the App with the involvement of a parent or guardian. The calculators are built for the Australian property and tax system. The App may be available in other countries, but its calculations apply Australian rules.

• Australian prices include GST. In other countries, the local price is shown in the App Store or Google Play. The price shown at the time of purchase applies.
• Daily export limits reset at midnight in your device's local time.
• We may change features, limits or prices in the future. We will not change the price of an active subscription except as permitted by Apple or Google, who will notify you and, where required, ask for your consent before a price increase applies.

• Free trial. Eligible new subscribers receive a 7-day free trial. Only one free trial is available per customer across all Mortgage Mind AU plans. Nothing is charged during the trial.
• Automatic renewal. Unless you cancel at least 24 hours before the trial or current billing period ends, your subscription automatically renews and your Apple ID or Google Play account is charged the plan price for the next period.
• Managing and cancelling. You can manage or cancel your subscription at any time in your device settings: on iPhone or iPad under Settings > [your name] > Subscriptions, and on Android in the Google Play Store > Profile > Payments & subscriptions > Subscriptions. Deleting the App does not cancel a subscription. After cancelling, paid features remain available until the end of the period you have paid for.
• Changing plans. Upgrades and downgrades are handled by Apple or Google under their rules, which decide when the change takes effect and whether any unused time is credited.
• Refunds. Payments are processed by Apple or Google, and refund requests are handled under their policies. This does not limit your rights under the Australian Consumer Law (see section 10).

If you use Broker Edition, you are responsible for how you use the reports with your clients. In particular, you agree that:

• you are authorised to use the name, firm name, logo and contact details you enter, and that they are accurate and kept up to date;
• any Australian Credit Licence number or Credit Representative Number you display is correct and belongs to you or your licensee;
• you will comply with all laws and licence conditions that apply to you, including the National Consumer Credit Protection Act 2009 (Cth), ASIC requirements and your licensee's policies, when you provide reports to clients;
• you will present reports as general estimates only, and not as a loan approval, a credit assessment or a recommendation; and
• we do not verify the details you enter, and we are not responsible for the content of reports you brand and distribute.

Reports exported on the Free plan include a sponsor banner. The banner may promote a third-party mortgage broker or lender, or our own advertising opportunity, and is labelled as sponsored. Sponsors are independent businesses. We do not endorse their services, and any dealings you have with a sponsor are between you and that sponsor. We do not share your calculation data or contact details with sponsors.

You must not:

• copy, modify, reverse engineer or decompile the App, except as permitted by law;
• bypass, disable or interfere with export limits, subscriptions or other access controls;
• use the App for any unlawful, misleading or deceptive purpose; or
• resell, sublicense or commercially redistribute the App or its content, other than Broker Edition reports provided to your own clients.

The figures you enter into the calculators are processed and stored on your device. We do not claim ownership of your inputs. PDF reports are created on your device, and when you share or email a report, you choose where it goes. You are responsible for sharing reports appropriately, especially reports containing other people's information. How we handle personal information is explained in our Privacy Policy.

The App, including its software, calculation methods, design, text and graphics, is owned by or licensed to BraindAI Pty Ltd. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, in line with these Terms and the rules of the store you downloaded it from.

• Your consumer rights. Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
• Other warranties. To the extent permitted by law, the App is provided "as is", and we exclude all other warranties, including that the App will be error-free, uninterrupted or that government rates and lender policies in the App are always current.
• Limits on liability. To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss arising from financial decisions made in reliance on estimates produced by the App without independent verification. Where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again.

• If you downloaded the App from the Apple App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. These Terms are between you and BraindAI Pty Ltd, not Apple. Apple has no obligation to provide maintenance or support for the App, and is not responsible for addressing any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• If you downloaded the App from Google Play, Google Play's Terms of Service also apply to your use of Google Play.
• If there is any inconsistency, the store's terms apply to the store's role (such as billing and refunds), and these Terms apply to the App.

We may update the App and these Terms from time to time. The current version will always be available at braindai.com/mortgagemind/terms and the "Last updated" date will change. If we make a material change, we will take reasonable steps to let you know, for example in the App. You can stop using the App at any time. We may suspend access to paid features if you breach these Terms, subject to the rules of the App Store or Google Play and your rights under the law.

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
